But whose building is it?
This event will look at a recently reported dilapidations case that hinged on answering the question “but whose building is it?”. The answer to this question was found by considering the degree of annexation of the demise; the design intention of the parties at the outset and whether the building could be relocated as a whole without its true character being fundamentally changed.
In this session, Ed Shaw will discuss the theory of annexation; the importance of showing the design intent of the parties when drafting the Lease; as well as the key requirement of undertaking due diligence throughout the process.
Andrew Ellingworth will use the case of The Royal Parks v Bluebird Boats Limited (where is acted for the Claimant as Expert Witness) to add some practical examples around these issues.
