Defective lease clauses
Several different ‘bad’ lease clauses will be considered.
Jon Rowling will discuss from a technical perspective how to approach the clause when producing a schedule or acting as an expert in a claim.
Lindsey Whittle will discuss how you deal with such a clause if you are stuck with it and some tips for dealing with it in litigation.
George Dowson will finish with discussing how you could better draft the clauses and give some ‘good’ examples.
Speakers
Lindsey Whittle is a property litigation solicitor who qualified in 2018 and has been part of the property litigation team at Trowers & Hamlins LLP since 2021. Lindsey has experience of advising a broad range of clients on contentious commercial landlord and tenant matters, including dilapidations issues; from initial advice on reinstatement and recovery, to bringing and defending High Court claims for dilapidations.
Jon Rowling is a building surveyor, a director at JLL, a dilapidations specialist, an arbitrator, independent expert, expert witness and (in Scotland) a court reporter. He practices in both the English and Welsh and the Scottish jurisdictions. Jon was lead author of the RICS Professional Statement for dilapidations and the RICS Dilapidations Dispute Resolution Scheme. He speaks frequently on dilapidations-related topics and is particularly interested in schedules of condition (as I’m sure we all are!). Jon was the author of the TFT Purple Book: A Guide to Dilapidations in the UK.
George Dowson is a senior associate in Trowers & Hamlins LLP’s Real Estate department and has experience in property transactions including acquisitions, disposals and management of investment property; acting for developers, vendors and purchasers on development matters; and advising on landlord and tenant work, having acted for both institutional landlords and high profile tenants. George acts for public, private and third sector clients understanding the challenges involved in leasehold negotiations. He has acted for both landlords and tenants across a wide range of sectors including office, retail, industrial and leisure and negotiated & documented commercial leases, including complex provisions and consideration of dilapidations issues.
